中鋼集團「中鋼運通」違法欠繳員工退休金 法院判決定讞

積欠員工勞退金總額逾1.4億元！

工會：全面撤查、立即依法補繳、全數償還

由中鋼公司100%轉投資，肩負維繫中鋼集團鋼鐵等原物料國際運輸的國營海運公司－中鋼運通公司（中運公司），過去在每月提撥船員勞工退休金時，違法高薪低報，利用「特別獎金」名目，規避薪資認定，導致長期少繳、積欠員工勞退金。2021年3月，過去曾於中運公司船隊擔任機匠一職的黃姓員工，在查覺自己遭高薪低報、少繳勞退金後，向勞保局提出檢舉。經勞保局查核確認中運公司違法屬實，同年3月底，對中運進行裁罰並公布公司及負責人姓名，另逕予調整每月所應提撥黃姓員工之正確勞退金。離譜的是，違法遭裁罰的中運公司，非但未改正，竟浪費資源持續濫訴，狀告勞保局。在歷經訴願遭駁回、台北高等行政法院判決敗訴後，今年9月28日，最高行政法院最後一次「打臉」中運公司，確認中運違法屬實，勞保局裁罰有理，全案終結定讞！

黃姓員工一案後，中鋼運通工會檢視全公司員工每月勞退金提撥情況，發現近五百位海勤船員，極高比例都有勞退金遭長期違法高薪低報而少繳現象，依不同職務，每人、每月少提撥之勞退金金額，從1,300元到逾2,700元不等。最保守估計，僅計算過去15年，中運公司積欠現職員工勞退金總金額就超過1.4億元！若將中途離職船員一併考量，違法少繳金額甚至可能超過2億元。

為此，中鋼運通工會明（14）日上午，特別邀請長期關注船員權益的 #立委洪申翰、 #勞保局代表 及專家學者，於立法院召開記者會，由勞保局對外說明中運公司違法高薪低報、少繳員工勞退金的事實與裁罰依據，工會與會代表也共同要求國營的中鋼運通公司，應立即依法補繳、全數償還過去15年來違法積欠所有員工的勞退金差額！

For over 15 years, CSE has systematically underreported seafarers’ salaries, misclassifying a portion of wages as "special bonuses" to evade pension contributions. This widespread violation has impacted hundreds of employees.

In March 2021, a former crew member reported the issue to the Bureau of Labor Insurance, which confirmed the misconduct and penalized CSE. The bureau adjusted the employee’s retirement contributions and publicized the case. Despite multiple legal defeats, including a final Supreme Administrative Court ruling on September 28, 2023, CSE continues to resist compliance.

A union-led review uncovered that nearly 500 seafarers had been systematically underpaid, withheld pensions have exceeded NT$140 million—potentially surpassing NT$200 million when accounting for former employees.

To demand full repayment, the union is holding a press conference on December 14, joined by Legislator Hung Shen-han, Bureau of Labor Insurance representatives, and legal experts to address CSE’s violations and legal obligations.
