高等法院高分院-關松屏案特別獎金一為工資

本會會員關松屏輪機長因被中運公司苛扣退休金,本會協助其與中運纏訟多年。過去在高等法院高雄分院判決中,法官罔顧勞資現實、片面聽取資方主張、判決立場偏頗。遭最高法院明確廢棄高等法院高雄分院判決,案件發回高等法院高雄法院重新審理,高等法院仍然固守己見,堅持船東可以特地性定期契約按航次與船員簽定期契約,這種判決不但推翻了最高法院對於勞基法以不定期契約保障勞工的穩定見解,更凸顯尸位素餐亟需要改革的司法制度。本會對於判決雖不滿意,但也對特別獎金一屬於工資,已是穩定見解感到欣慰!本次的高等法院判決為我國畸形的船員勞動條件吹響改革的號角,未來希望弟兄們團結攜手改變台灣船員的勞動環境。

Chief Engineer Kuan Song-ping faced years of legal battles after China Steel Express unfairly withheld his pension. Despite the Supreme Court overturning a biased ruling by the High Court Kaohsiung Branch, the court maintained its stance, allowing shipowners to sign voyage-based fixed-term contracts with crew members—contradicting the Supreme Court's position that labor laws should ensure job stability through open-ended contracts.

While the ruling remains disappointing, the court's confirmation that the special bonus qualifies as wages is a positive development. This decision highlights the urgent need to reform Taiwan's flawed maritime labor system, and we urge all seafarers to stand together in reshaping their working conditions.
